Blunt signs bill on keeping guns in emergencies

JEFFERSON CITY, Mo. (AP) -- Gov. Matt Blunt has signed legislation ensuring
that Missouri residents could not have their guns taken away during an
emergency.

The legislation spells out that no government or individual can decide in an
emergency to take away guns and ammunition from those who lawfully possess them.

The House passed the measure Thursday on a 150-2 vote. The Senate also
passed the bill overwhelmingly in mid-March. Blunt signed the measure later
Thursday, his office said, but also planned a ceremonial signing today in St.
Louis during the National Rifle Association's annual convention.

The bill is a response to the fallout after Hurricane Katrina in New Orleans
in August 2005.

"Family heirlooms were taken away, and after this state of emergency is
over, there is no accountability, there is no tracking and no one knows who
they belong to," said Rep. David Pearce, R-Warrensburg.

State and federal law enforcement officers in Louisiana confiscated hundreds
of guns after the levees failed and the city began to flood. Several pro-gun
groups sued, and the city last spring began returning weapons to owners with
paperwork for them.

After the hurricane, gun-rights groups have embarked on nationwide efforts
to prevent the seizure of guns during emergencies.

The legislation contains no penalty for taking firearms during an emergency,
but supporters say that the threat of litigation would be enough to keep police
and government officials in line.

Rep. Michael Daus said he was concerned that bill could make it harder for
police to do their jobs during an emergency. Daus, D-St. Louis, said he thinks
it is likely people's possessions will be at least damaged by an emergency,
making it difficult to determine whether a weapon is owned lawfully. He
predicted the confusion could cause problems.

I'm glad you got it, and I'm sure it will be a good thing. What I wonder is how will they tell who the can legally own one during an emergency. Do they call it in and do a NICS check on the spot, or what? This gets me "The legislation spells out that no government or individual can decide in an emergency to take away guns and ammunition from those who lawfully possess them." How will they know that you can legally own one when the SHTF? Anyone have any ideas?

There's a 'Castle Doctrine' bill (SB62), and a bill to eliminate the PTA system (HB462) working their way through the house and senate in MO as well. Both stand a good chance of becoming law this year. Contact your representatives!

The 'Castle Doctrine' bill is a good one. There were several proposed, with some of them less than ideal. This one was amended to read 'where he or she is lawfully present', giving a citizen the right to defend themselves without fear of prosecution, no matter where they happen to be attacked.

The PTA system, for those unfamiliar with it, requires that anyone wishing to purchase a handgun in MO first go to their Sheriff and ask for permission. They require a (redundant) background check, charge you $10, and can (depending on the Sheriff's policy) make you wait a week. This law dates back to the 'Jim Crow' era, and is a shameful reminder of past civil rights abuses in our state. It needs to go, in a bad way.

"no government or individual can decide in an emergency to take away guns and ammunition from those who lawfully possess them."

-->That's passing in IN even as we speak. I like to live in a state where there is as much pro-2nd legislation as there is anti-legislation in the system...and thus far, the pro 2nd has ben winning nicely.

I look at it this way. There is nothing really stopping the police or other law enforcement from showing up at your house and taking your firearms during natural disasters. Not that they will automatically do that, but now at least you have a course to follow if they do.

if someone shows up to take your weapons away during an emergency, there is only one course of action. They aim to leave you defenceless in the wild west. I don't forsee that happening after the last time, but anything is possible. Plan for the worst and hope for the best.

"The time to use them is when they come for them"

If the Prussian Jews had acted such in the run up to Nazi germany, the story woulda been a lot different...or the Poles in the Warsaw ghetto.

If they declare martial law theres NO WAY i'm giving them up..... if they declare martial law, then our constitutional rights are suspended...... and my weapons are the only thing i'd have to protect myself with...... when i'm dead, then they can have em.......
